Government facilitates work visa for foreigners

The Government reduced the bureaucracy for the work permit of foreigners in Brazil. Now, companies and workers will have to submit fewer documents and the work permit will be granted in a more agile manner.

Another change is the stimulus for students of master’s and doctoral degrees to work in the country during the holiday period, with limited period up to 90 days.

The foreign worker may receive authorization to work in the country even before submitting the documents and translated diplomas, a requirement of the Government. The deadline for submission of these documents is 60 days. Before the process of granting the visa was paralyzed until the presentation of the above mentioned documents.

The simplification will also allow foreign workers to submit documents via the Internet. Digitalized documents will be stored in the Office of General Coordination of Immigration (CGIg). If the employee comes to work in Brazil as an inter-company transfer or within the conglomerate, a number of documents that prove the affiliation are also dispensed.

From now on, the foreign worker can still obtain a work permit in the country even if his/her remuneration is lower than that received in the country of origin. According to the resolution that regulated the work permit for foreigners until then, this was not allowed.

In the case of master’s and doctoral students, the resolution published on May 17, 2013 provides that the authorized work does not necessarily must be linked to the training course or a student exchange. For granting of temporary visa to this kind of students, that is not considered a work visa, the employer must obtain an authorization from the Ministry of Labor and present the relevant documents.

Companies: In relation to documentation of companies, there will be an exemption from submission a disclaimer through which a company assumes any medical and hospital expenses abroad to the Ministry of Labor. In total, the number of documents was reduced from ten to six.
